Order - This constitutes an agreement for photography services between the photographer ( INTELATOURS ), and clients named above, ( The Couple ), for wedding photography coverage as described in this seven page contract.

Minimum Fee - There is a minimum fee of $150 for Labor, estimated cost for film, processing/developing, travel and or mileage paid in advance of the event. Additional products ordered totaling an amount above the minimum fee paid, will be due one half at the time of order, and the remaining half at the time the order is delivered. All products will not be released until all payments have been received. If a remainder amount above the Minimum Fee is not provided upon the date of product delivery, the couple forfeits the minimum fee amount and it is remains with INTELATOURS.

Payment Schedule - A non-refundable retainer equal to the Minimum Fee, plus any additional cost required under Other Expenses is due at the time of signing. The final payment of the total price is due upon the day of the wedding. If the total amount of the fee agreed upon is not paid to INTELATOURS according to the above terms, it will be interpreted by INTELATOURS as a breach of contract. Therefore, INTELATOURS will be relieved of any and all obligation to perform the remainder of the contract, and all of the money will be given back to the client, except the retainer and any fees for services already provided, which is non-refundable. There will be a $50 fee for any returned check.

Retainers and Cancellations - Upon signing of the contract and receipt of the retainer , INTELATOURS reserves the time and date agreed upon, and will not make other reservations for that time. For this reason, the retainer paid to INTELATOURS is non-refundable. If the couples’ wedding is rescheduled or postponed, the retainer paid may be applied as credit towards a future wedding booking, within a six month period from the original date, based on INTELATOURS' availability. If INTELATOURS is unavailable on the new date, or if the wedding is cancelled, the retainer received will be kept by INTELATOURS, and any other monies paid to INTELATOURS will be returned to the client, except any fees for services already provided, which is non-refundable.

Overtime Fee - There will be a charge of $50 for each hour INTELATOURS is retained over the contracted time frame of hours that INTELATOURS photographs at the wedding, with a one hour minimum charge. This extra fee will be paid before the photographs of the wedding are sent for printing. INTELATOURS agrees to notify the couple at least 15 minutes before overtime charges will begin to accrue.

Model Release and Copyright Retention - INTELATOURS retains all copyrights to all photographs taken before, during or after the wedding, bridal portrait or engagement portrait. As such, the signing of this contract gives INTELATOURS the right to reproduce any photographs taken before, during or after the wedding, bridal and engagement for the purposes of advertising, portfolio use, competition, website, or any other reason that it sees appropriate. For further information, the mere possession of a photograph does not grant the right to duplication or copies of any kind, including computer scans, by anyone other than the original photographer or INTELATOURS, UNLESS the negatives and copyrights have been sold to the party whom is in possession of them. Copying INTELATOURS' photography without the express prior written permission is a violation of federallaw (17 U.S.C.501 of the Copyright Act.) A Provision will be offered to purchase the physicalpossession and shared copyright of a couple’s wedding negatives and/or digital files.

Specific Photographs - Every effort will be made to assure your satisfaction according to our professional standards. However, INTELATOURS is not responsible for any subjective interpretations of photography. Errors that occur from outside interference such as changes in lighting, location, time and subjects during the time of photography are beyond the control of INTELATOURS. Photography is based on time and lighting and when the proper time allowance and lighting is used the better the quality and size of the photography can be. Furthermore, while INTELATOURS will make every effort to take all of the photographs agreed to by INTELATOURS and the couple, the couple understands that a wedding is a very fast moving event, and there are no guarantees that any specific photographs will be taken. When ordering final prints, there might be slight color differences between orders placed at different times. These variations are due to technical reasons beyond our control.

Guarantee of Product Prices - INTELATOURS has provided the Pricing Guide at the time the contract is signed. Due to the nature of business, the prices listed in the Pricing Guide will only be guaranteed for one month after the day of the wedding. After one month the couple will need to refer to the most current Pricing Guide, easily accessible through our website or contacting INTELATOURS direct.

Albums and Photographic Reprints - The client understands that albums and photographic reprints are custom products, and therefore cannot be returned for any reason. Every effort will be made to replace pictures with quality issues such as: scratches, tears, stains, or any other physically damage. These issues are to be discussed at the time of delivery of the final product. Once the couple accepts delivery, the product is assumed in acceptable condition. The couple also understands that because these are custom products, time of completion will vary depending on order and product availability.

Liability, Sickness, or other Circumstances - INTELATOURS takes extra care to ensure equipment, exposure, processing, and delivery of photography for and to the couple. As with everything in life, there is always a small risk, such as negatives/digital images may be lost or damaged during shipping or processing at a lab. INTELATOURS is not responsible for any losses or damages to the couple’s orders or negatives while they are out of the INTELATOURS’ direct possession. In the event of severe medical, natural, acts of God, or other emergencies it may be necessary to retain a photographer other than INTELATOURS. In the event of personal illness or other circumstances beyond the control of INTELATOURS, a substitute photographer may be sent to fulfill the obligations ofINTELATOURS herein contracted. INTELATOURS will make every effort in providing a photographer of equivalent experience and ability to fulfill the contract. In the event that this contract cannot be completed due to an Act of God, severe weather, flood, fire, warfare, government laws or regulations, federal or local government disruption, electrical failure, strikes by suppliers, equipment malfunction, operator error, or any other event or act outside of the control of INTELATOURS, or any other reason or causes whatsoever that render performance not possible, the couple agrees to hold INTELATOURS, the photographer, and heirs harmless for any damages, causes of action or claims arising out of non-performance. The couple agrees that sole remedy shall be limited to a refund of deposits paid by the client, except the retainer and any fees for services already provided which show no error , which is non-refundable.

Other Expense/s - When formal attire, travel tickets/expense, lodging and/or any other goods or services is required for the photographer/s attending and/or working at the wedding ceremony, an additional fee equal to the cost necessary to obtain the Other Expenses will be forwarded to The Couple and added into the required retainer.

Negatives/Digital files Release Provision- Copying INTELATOURS' photography without the express prior written permission is a violation of federal law (17 U.S.C.501 of the Copyright Act.) This is a Provision for the couple mentioned above to purchase the physical possession and shared copyright of the couple’s negatives and/or digital files. INTELATOURS has made the sale of the negatives or digital photo files of the couple's wedding mentioned herein at a price of ( $ 1.50 )two dollars per negative and/or digital file or an agreed upon sum of ($ .00 ) ________________________ for the entire set of negatives and/or digital files. The attached signatures of the couple and INTELATOURS representative constitute an acceptance of the terms and prices of the sale of the negatives and/or digital files. It is fully understood by the couple that INTELATOURS can not guarantee the quality of any prints made from the negatives or digital files purchased herein after the sale, release and physical possession is transferred to the couple.

INTELATOURS has notified me of the overtime charges that will be accrued if they continue to provide photography services beyond the contracted time.
